Cleveland Lead Safe Certificate for rentals (2026)
Who it covers
Every residential rental unit in Cleveland built before January 1, 1978. The city phased deadlines in on a quarterly schedule from March 1, 2021, with every unit due by March 1, 2023.
How long it lasts
Lead Safe Certificate: 2 years (re-apply no earlier than 30 days before it expires). 20-year exemption after full abatement with a LIRA.
What it costs
No city application fee. Risk assessments from about $350 (City of Cleveland). Rental registration $70 per unit per year.
If you don’t comply
The city's first step is a $200 civil ticket for not having a valid Lead Safe Certificate. Unpaid tickets can be added to the property tax bill. The city may also file a minor-misdemeanor or first-degree-misdemeanor complaint in Housing Court (Ohio caps fines at $150 and $1,000 per offense). An owner who gets a repair citation and shows no progress every 90 days faces fines, prosecution, or an order to vacate.
What you need and when
| What you need | When | Cost |
|---|---|---|
| Lead Safe Certificate Valid 2 years from issuance. Re-apply no earlier than 30 days before it expires. The report must be dated within 90 days before you submit. Since Oct 18, 2024 the city only accepts a lead risk assessment (or a clearance after full abatement); a simple clearance exam no longer qualifies. If the assessment finds hazards, the city issues a citation and you must show repair progress every 90 days. A valid certificate is required for the Certificate Approving Rental Occupancy that you need before renting. | every 2 years; first deadline was March 1, 2023 | No city application fee; you pay the private risk assessor (city says from $350) |
| Rental registration (non-owner-occupied unit) File every year on or before March 1. Needs a Local Agent in Charge who lives in Cuyahoga County (the owner can serve if they live in Cuyahoga or a neighboring county). Your Lead Safe Certificate number finalizes the registration. | renew every year by March 1; every year | $70 per unit per year; $100 late fee if expired; capped at $30,000 per owner per year |
Not covered
- Built on or after January 1, 1978
- Units occupied by the owner (an owner-occupied unit in a multi-unit building is exempt; the other units are not)
- 20-year exemption for units abated of all lead hazards, shown by a full lead inspection and risk assessment (LIRA) done within the last 20 years
- Units left empty with no rent received, if the owner files an affidavit every year (the 2026 amendment reportedly removes this; see conflicts)
Certificate types
- 2-year Lead Safe Certificate: A licensed lead risk assessor found no lead hazards (or found hazards that are under control), assuming all paint is lead paint. 2 years
- 20-year exemption: A full lead inspection and risk assessment (LIRA, with XRF paint testing) shows the unit was abated of lead hazards. 20 years
How to get inspected
An Ohio Department of Health-licensed lead risk assessor for the 2-year certificate. A full LIRA with XRF is needed for the 20-year exemption. A clearance technician may only clear work done after a risk assessment. The assessor cannot be the owner, a family member, an employee, or the property manager, or have a financial stake in the result. The 'Lead-Safe Auditor' in the ordinance is a city staff role that monitors the program; it does not inspect properties.
Typical cost: From $350, varying by assessor and type of assessment (City of Cleveland) (source). More in what a lead inspection costs.
Fees
- Lead Safe Certificate application: $0 (no application fee) (clevelandohio.gov)
- Rental registration: $70 per unit per year; $100 late fee; $30,000 cap per owner per year (codelibrary.amlegal.com)
- Revoked registration or rental occupancy certificate: $100 fine (codelibrary.amlegal.com)
What to give tenants
- The city says each risk assessment and its compliance status are made public in redacted form and given to the tenant in full.
- Federal EPA/HUD lead disclosure and pamphlet apply too.
The federal lead disclosure rule applies on top of this for nearly every rental built before 1978. What it requires.

Evictions and rent
Cleveland Municipal Court Local Rule 3.015 used to require a lead-safe affidavit with every eviction filing. On Aug 11, 2022 the Eighth District Court of Appeals held it unenforceable (Shaker House LLC v. Daniel), so evictions no longer require proof of certification. The certificate itself is still required.

How long is a Cleveland Lead Safe Certificate good for?
Two years from the date it is issued. A unit with all lead hazards abated can get a 20-year exemption instead. An October 2026 ordinance will move to 3- to 20-year terms once it takes effect.
Can I still use a clearance exam for a Cleveland lead safe certificate?
No. Since Oct 18, 2024 the city requires a lead risk assessment by a licensed risk assessor. A clearance is accepted only after abatement work, or to clear repairs that follow a risk assessment.
How much does a Cleveland lead safe certificate cost?
The city charges no application fee. Risk assessments start at about $350. Rental registration is a separate $70 per unit per year.
What if the risk assessment finds lead hazards?
Submit it anyway. The city issues a citation with a repair plan, and you must show progress every 90 days to avoid fines or prosecution.
What is the fine for not having a lead safe certificate in Cleveland?
The city starts with a $200 civil ticket, which can be added to your property taxes if unpaid. It can also file misdemeanor charges in Housing Court.
Do I need a lead safe certificate to evict a tenant in Cleveland?
Not anymore. An appeals court struck down the court rule requiring it in 2022, but you still have to hold a certificate to rent legally.
